I understand that TRI is a “for sale/rent by owner "advertising company. TRI is NOT a BROKER. The advertising fee is for marketing expenses that pool advertising resources with those of other seller/ renters to maximize exposure.
I warrant and guarantee that all information that I have or will provide TRI relating to the marketing of my Listing is complete, truthful, and accurate to the best of my knowledge. I further agree to indemnify TRI for any and all damages of any nature that arise from any inaccurate, incomplete, or false information that I provide to TRI.
I understand TRI will provide my Listing information to corporations, travel agents, and the public, as listed on
I understand that TRI will forward all inquiries to me so I may negotiate the sale or rental of my Listing directly with any prospective buyers/or renters. I understand that once TRI has forwarded an inquiry to me they have no duty to, nor will they, assist me or advise me in negotiating the sale or rental of my property.
I understand that I am paying TRI a one time, nonrecurring advertising fee, to advertise my Listing for a period of (180) days. If I have not received an acceptable offer within (180) days TRI will renew my advertising for one additional 180 day period at the company’s expense. In order to take advantage of this additional 180 day period, I understand that I must notify TRI in writing that I have not received an acceptable offer and wish to continue advertising no later than midnight of the 10th day after the termination of the original 180 day period.
We will also advertise your Listing in the following ways: We run general advertisements promoting traffic to our website www.Tri-Marketing.com which contains your advertised Listing. TRI also has full time PAID search engine ads on the top 3 search engines, utilizing keywords associated with renting/selling/buying of Luxury Listings. We utilize the following major and well known social media sites to generate web traffic and views on our website so people can find and view your advertisements: Facebook, Twitter and YouTube.
I acknowledge and agree that TRI is and at all times will be the sole owner of all trademarks, trade names, logos, symbols, other indicia of origin, designs, inventions, patents, advertising and promotional materials, original works of authorship and other copyright protected materials, trade secrets, and other intellectual Listing or proprietary information relating to their Listing marketing business, websites, and all other marketing materials.
I understand that there is NO active renter or buyer at the present moment, and TRI is in no way affiliated with my Listing and/or exchange company
This Owner Agreement shall be governed by and construed according to the laws, without regard to the conflicts of laws or provisions thereof. Should any controversy or dispute arise out of this Owner Agreement, the parties agree to attempt to formally mediate the controversy or dispute in good faith before commencing any legal action. Any controversy or dispute that cannot be resolved by formal mediation may be filed and prosecuted in any court of competent jurisdiction. Each Party hereby consents and submits to the personal jurisdiction of such courts and waives any objections thereto, including any objection based on improper venue or forum non-conveniens.
